The Board held a discussion at a regular Board meeting earlier this year concerning veterinary school students performing surgery under the supervision of a New Mexico-licensed veterinarian.
The Board determined that under 61-14-14 Exemptions, B. regular students in a veterinary school performing duties or actions assigned by an instructor or working under direct supervision of a licensed veterinarian during a school vacation period, a student can perform duties similar to those of a veterinary technician; a veterinary technician cannot perform surgery.  The Board iterated Rule B.  Only veterinarians licensed by the state of New Mexico may practice veterinary medicine in New Mexico; working under the supervision of a licensed veterinarian does not waive the requirement to hold a license.
The Board will hold another discussion of 61-14-14 B. and B. at its next regularly scheduled Board meeting to be held October 3, 2014.

Gross Receipts Tax

The Board recently learned from its auditors, Ricci & Company, that the Taxation and Revenue Department changed its statute related to tangible personal property used in the practice of veterinary medicine. Claims can be filed for a refund of Gross Receipts Taxes paid for the taxable years 2007-2010 based upon the previous statute. Attached is the prior statute and regulation for your use in making a claim. Click here for statute

Filings for the gross receipts tax refunds continue to be approved by the Taxation and Revenue Department. The time frame for the entire filing and approval process for claims in excess of $10,000 is typically six (6) months; claims less than $10,000 process sooner. Don't miss out on this opportunity to recoup gross receipts taxes paid on tangible personal property in relation to your practice of veterinary medicine.

USDA Extends Deadline for National Veterinary Accreditation Program
WASHINGTON, Sept. 28, 2010 - The U.S. Department of Agriculture's Animal and Plant Health Inspection Service (APHIS) has extended the deadline for accredited veterinarians to elect to participate in the National Veterinary Accreditation Program (NVAP) until further notice.  Currently, accredited veterinarians must elect to continue their participation in the NVAP in order to maintain accredited status.
Thousands of election to participate forms are being processed each week; however, the sheer volume of forms combined with the time it takes to process each form necessitates the extended deadline.  Accredited veterinarians provide valuable regulatory services on behalf of the federal government.  Allowing currently accredited veterinarians to continue performing their accredited duties after they have elected to participate but before they have received their renewal date from APHIS ensures that these veterinarians can continue to provide accredited services to the public.
To date, approximately 50,000 veterinarians have elected to participate in NVAP, and another 10,000 are expected to do so.  Processing the applications is time consuming, involves verifying data on each application and often means contacting one or more people to make certain the information entered in the NVAP database is correct.
During this extended deadline period, APHIS will continue its outreach efforts to ensure that accredited veterinarians who have not yet elected to participate do not inadvertently let their accreditation lapse.
For additional information and application forms to elect to participate, please see www.aphis.usda.gov/animal_health and click on Veterinary Accreditation.
